Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the mobile game Dinos Blast Island (the “Game”) and of the website https://www.witensi.com (the “Website”), both published by Witensi (“we”, “us”). Please read them carefully.

1. Acceptance and purpose

By downloading, installing or using the Game, or by browsing the Website, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Game or the Website.

These Terms apply in addition to the terms of the store from which you downloaded the Game (Google Play or the Apple App Store).

2. Publisher

The Game and the Website are published by Witensi. Full legal information about the publisher is available in the Legal notice section of the website. For any question, contact us at contact@witensi.com.

3. Age and minors

The Game is not intended for children under 16. You must be at least 16 years old to download and play the Game.

If you are between 16 and 17 years old (or under the age of majority in your country), you may only use the Game with the permission of a parent or legal guardian, who accepts these Terms on your behalf, supervises your use of the Game and is responsible for it, including any purchases made through their store account.

Parents can restrict or disable in-app purchases through the parental-control settings of Google Play and the App Store, and through the Game's built-in parental control, which is protected by a password (see our Privacy Policy).

4. Licence and intellectual property

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the Game on a compatible mobile device that you own or control, for your private, non-commercial entertainment only.

The Game, including its software, graphics, dinosaurs, characters, names, logos, sounds, music, texts and all other content, is protected by intellectual property law and remains our property or that of our licensors. All rights not expressly granted are reserved. You may not copy, modify, decompile, distribute, sell, rent or create derivative works from the Game, except where the law expressly allows it.

5. Rules of conduct, cheating and abuse

You agree not to:

• use cheats, exploits, automation software, bots, hacks, mods or any unauthorised third-party software that modifies or interferes with the Game;
• attempt to obtain virtual items, currencies or advantages by any means other than those intended by the Game;
• interfere with the proper operation of the Game or the Website, or attempt to access data or systems you are not authorised to access;
• use the Game or the Website for any unlawful purpose.

In case of breach, we may suspend or terminate your access to all or part of the Game, remove improperly obtained items and take any other appropriate action.

6. Progress and saved data

Your game progress (levels, collection, currencies, items, settings) is saved locally on your device. The Game does not require a user account and does not currently offer cloud saving. Uninstalling the Game, resetting or changing your device may result in the permanent loss of your progress. We cannot restore lost local progress.

7. Virtual items and virtual currencies

The Game includes virtual currencies (such as Coins and Gems), virtual items (such as Rescue Totems, boosters and chests) and collectible dinos. They can be earned by playing, through rewards or, for some of them, purchased with real money.

Virtual items and currencies have no monetary value, cannot be exchanged for real money or items of value, and cannot be transferred or resold. They are a limited licence right to use features of the Game, which we may modify, rebalance or withdraw as part of the Game's evolution. Unused virtual items are not refunded, except where required by law.

8. In-app purchases

The Game offers in-app purchases (virtual currencies, offers, exclusive dinos and the Season Pass). Payments are processed exclusively by Google Play or the Apple App Store under their own terms; we do not receive or store your payment details. Prices are displayed in the Game in your local currency, including applicable taxes, and may change.

Purchases are delivered to the device on which they were made. Refund requests are handled by Google or Apple in accordance with their policies; where you have a statutory right of withdrawal, you acknowledge that digital content is delivered immediately after purchase, with your express consent, and that your right of withdrawal is therefore lost once the content has been delivered, to the extent permitted by law.

9. Season Pass

The Season Pass is a one-time purchase valid for one month from the date of purchase and tied to the calendar month of purchase (the “season”). It is not an auto-renewing subscription. While active, the Season Pass grants:

• a one-off bonus of Coins for that season;
• the exclusive dino of the month, added to your collection;
• no interstitial advertisements;
• unlimited replays after a defeat in Rescue and Adventure modes;
• no multiplayer fatigue for your dinos;
• free gift-wheel spins every day, in addition to the spins available by watching rewarded videos.

Benefits are available only while the pass is active and on the device where it was purchased. The exact rewards may be adjusted in future versions of the Game; any change will be shown in the Game before purchase.

10. Advertising and rewarded videos

The Game may display advertisements, including rewarded videos that you can choose to watch in exchange for an in-game reward (for example a gift-wheel spin or recovering tired dinos). Watching a rewarded video is always optional. A reward is granted only when the video has been watched in full, as reported by the advertising provider. Advertisements are provided by third-party partners described in our Privacy Policy.

Where the law requires it, personalised advertising is shown only with your consent. This consent is requested when you first launch the Game and can be given, refused or withdrawn at any time in the Game's settings.

11. Multiplayer, opponents, rankings and fair play

Multiplayer mode unlocks after completing a given level of Adventure mode (level 59 in the current version). You build a team of three dinos and face an opponent in a duel. In the current version, opponents are controlled by the Game, the duel is played on your device, and the ranking shown in the multiplayer home is generated by the Game for entertainment purposes; it is not a live worldwide ranking of real players.

After a defeat, your dinos are tired for a limited time (20 minutes in the current version); you may wait, watch a rewarded video or use a Rescue Totem. We may change the rules, durations, rewards and unlock conditions of Multiplayer as the Game evolves. Any attempt to manipulate duels, trophies or rankings is a breach of these Terms.

12. Updates, availability and maintenance

We may update, modify, add or remove features, content, levels, dinos, modes, prices and rewards at any time to improve or maintain the Game. Some updates may be required to continue playing. The Game and the Website may be temporarily unavailable for maintenance or for reasons beyond our control. We may discontinue the Game with reasonable prior notice, in which case virtual items and currencies will no longer be usable; no refund will be due except where required by law.

13. Third-party sites and services

The Game and the Website may contain links to websites or services operated by third parties, such as the stores, advertising partners or social networks. We do not control these third parties and are not responsible for their content, their terms or their handling of your data. Your use of a third-party site or service is at your own risk and governed by that third party's own terms and policies.

14. Warranties and liability

The Game and the Website are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranty that they will be uninterrupted, error-free or compatible with your device.

To the fullest extent permitted by applicable law, we shall not be liable for indirect or consequential losses, loss of data or loss of game progress. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your statutory rights as a consumer.

15. Force majeure

We shall not be liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, such as natural disasters, fire, flood, war, acts of terrorism, riots, labour disputes, acts of public authorities, failures of power or telecommunications networks, or failures of hosting providers, stores or other third-party services. Our obligations are suspended for as long as the event lasts, and we will use reasonable efforts to resume performance as soon as possible.

16. Governing law and consumer rights

These Terms are governed by French law. If you are a consumer residing in another country of the European Union, you also benefit from the mandatory consumer-protection provisions of your country of residence.

In case of dispute, please contact us first at contact@witensi.com so that we can look for an amicable solution. Consumers residing in the European Union may also use the European Commission's online dispute resolution platform (https://ec.europa.eu/consumers/odr). Failing an amicable solution, the competent courts will be determined in accordance with applicable law.

17. Severability

If any provision of these Terms is held invalid, illegal or unenforceable by a competent court or authority, that provision shall be applied to the maximum extent permitted, and the remaining provisions shall remain in full force and effect. The invalid provision shall be deemed replaced by a valid and enforceable provision that comes closest to its original purpose.

18. Changes to these Terms

We may update these Terms to reflect changes in the Game, in our services or in the law. The date of the latest version is shown at the top of this page. Material changes will be announced in the Game or on the Website. Continuing to use the Game after a change takes effect means that you accept the updated Terms.

Annex — Right of withdrawal (European Union)

If you are a consumer residing in the European Union, you in principle have the right to withdraw from a contract for the supply of digital content within 14 days of its conclusion, without giving any reason. For in-app purchases, however, you expressly request immediate delivery of the content and acknowledge that you thereby lose your right of withdrawal once the content has been delivered, in accordance with Directive 2011/83/EU and, in France, Article L.221-28 of the Consumer Code. For purchases made through Google Play or the Apple App Store, refund requests are in practice handled by Google or Apple under their own procedures.

Where the right of withdrawal applies, you can exercise it before it expires by sending us an unambiguous statement of your decision at contact@witensi.com, for example using the model form below:

If a withdrawal applies, we will reimburse all payments received for the purchase concerned without undue delay and at the latest within 14 days of the day we are informed of your decision, using the same means of payment as the one used for the initial transaction, unless you expressly agree otherwise.
